Subscription, Billing & Refund Terms

These Subscription, Billing & Refund Terms are part of the Terms of Service for the Social application (the "Service") operated by Breakpoint Labs LLC ("Breakpoint Labs"). They govern paid plans, trials, usage limits, one-time boosts, and refunds.
1. Plans and pricing
The Service offers a free tier, paid subscription plans, and one-time "Boosts." The prices shown in the app at checkout are always the authoritative source of truth and may change as described in Section 9. As of the last-updated date above, the plans are:
- Free — a limited trial: a set number of conversation analyses and chat messages, no
card required.
- Unlimited (monthly) — $11.95/month. No per-session or per-message caps, subject
to the fair-use policy in Section 4.
- Unlimited (annual) — $111.95/year (about $9.33/month). Same features and
fair-use policy as monthly.
- Boost — $11.95 one-time. Adds additional fair-use headroom to the current
billing period (Section 5).
2. Free trial
If we offer a free trial, the trial provides limited usage (e.g., a set number of trial sessions and chat messages). When the trial ends or its limits are reached, you must subscribe to continue using paid features. Unless stated otherwise at sign-up, trials do not automatically convert into a paid subscription that charges your card without your action.
3. Billing and renewal
- Paid subscriptions are billed in advance on a recurring basis (monthly or annual) through
our payment processor, Stripe.
- Subscriptions automatically renew at the then-current price until cancelled.
- By subscribing, you authorize us (via Stripe) to charge your payment method for the
applicable fees, taxes, and any one-time purchases you make.
- You are responsible for keeping your payment method current. Failed payments may result
in suspension or downgrade.
4. Usage limits and fair use
Free tier. The free tier includes fixed allowances (e.g., a set number of conversation analyses and chat messages). When an allowance is used up, the related feature is unavailable until you subscribe.
Unlimited plans — fair-use policy. Unlimited plans have no per-session or per-message caps. However, every analysis, chat message, replay, and transcription has a real third-party AI computing cost, so each Unlimited account includes a monthly fair-use allowance: a ceiling on the underlying AI processing cost we incur for your account in a billing period. The allowance is set as a fixed percentage of your plan's effective monthly price and is calibrated to exceed the usage of even our heaviest typical users — on the order of dozens of full conversation analyses and hundreds of coach chat messages per month. The vast majority of subscribers never encounter it.
How it works:
- No surprise charges, ever. Reaching the fair-use allowance never results in an
automatic or overage charge. AI features simply pause.
- Advance notice. The app shows an indicator when you have used roughly 80% of your
allowance for the period.
- Your options at the ceiling. Wait for your allowance to reset at the start of your
next billing period, or purchase an optional one-time Boost (Section 5) to add headroom immediately. Your sessions, history, portrait, and account remain fully accessible either way — only new AI processing pauses.
- Resets. The allowance resets in full at each billing renewal and is recalculated if
you change plans.
Abuse. The fair-use allowance exists to keep "unlimited" sustainable for individual, personal use. Automated, scripted, shared-account, resold, or other non-personal usage patterns are not covered by any plan and may result in throttling, suspension, or termination under the Acceptable Use Policy.
We may adjust the fair-use allowance over time (for example, as AI costs change). Material reductions that affect you will be communicated in advance, consistent with Section 9.
5. Boosts
A "boost" is a one-time purchase that adds additional usage headroom to your account for the current period. Boosts are consumable, are applied immediately, and are non-refundable once the added headroom has been made available, except where required by law.
6. BYOK (bring your own key)
If you use a BYOK plan, you are responsible for your own third-party AI API key, its costs, and compliance with that provider's terms. We are not responsible for charges you incur with your own key, and your key is used only to provide the Service to you.
7. Taxes
Prices may exclude applicable taxes. You are responsible for any taxes, levies, or duties imposed on your purchase, which may be added at checkout.
8. Cancellation
You may cancel a subscription at any time through the in-app settings or the Stripe Customer Portal. Cancellation stops future renewals. Unless required by law, cancellation does not retroactively refund the current period; you retain paid access until the end of the period you already paid for, after which your account moves to the free tier.
9. Price and plan changes
We may change prices, plans, and included usage. For recurring subscriptions, we will give advance notice of price increases that affect you before they take effect at your next renewal, and you may cancel before the change applies.
10. Refunds
Refund rules differ by jurisdiction. EEA/UK consumers may have statutory withdrawal rights; some jurisdictions require specific refund disclosures. Adjust with counsel.
- Except as required by law or expressly stated, fees are non-refundable and there are
no refunds or credits for partial periods, unused allowances, or boosts.
- If you believe you were charged in error, contact mycoach.social_support@breakpointlabs.space within 30 days and
we will review in good faith.
- Statutory consumer rights (including any right of withdrawal) are not affected by this
section.
11. Mobile purchases
If you subscribe through a mobile app store, the purchase, billing, and refunds may be handled by the app store under its rules, and the Mobile EULA applies. On native apps, in-app purchase buttons may direct you to subscribe on the web.
12. Chargebacks
Initiating a chargeback without first contacting us may result in suspension of your account. Please contact mycoach.social_support@breakpointlabs.space first so we can help.
13. Failure of payment services
If payment services are unavailable (for example, if Stripe is not configured or is down), some purchase features may be temporarily disabled. This does not entitle you to damages.
